Terms & Conditions
America’s Test Kitchen Boston EATS (“Festival”) is presented by America’s Test Kitchen (collectively, “Festival Organizer”).
Festival Organizer reserves the right to make alterations to the Festival program. Festival Organizer may add, withdraw or substitute presenters, sponsors or participating partners at any time and all events, prices, personalities, performances, venues, dates and times are subject to change without notice.
EVENTS BEYOND OUR CONTROL
Festival Organizer accepts no responsibility, financial or otherwise, for cancellation or interruption of the Festival because of inclement weather or other acts or events beyond Festival Organizer’s control. Festival Organizer may postpone, cancel, interrupt or stop the Festival on this basis, at its sole discretion, and no refunds or credits will be made by Festival Organizer for such action.
Age and other admission restrictions apply. All Attendees must be 21 years of age or older and admission will be denied without proper proof of age without refund. Festival Organizer reserves the right, in its sole discretion, to refuse admission to, or evict, any person who appears intoxicated, inebriated or otherwise impaired or whose conduct is disorderly or inappropriate.
TICKETS; ALL SALES FINAL
Tickets represent a revocable license. Each Attendee agree to be bound by all of the Terms and Conditions. Tickets are available for purchase via the Festival website, www.atkeats.com. Ticket availability at the door is not guaranteed and will be sold on a first-come, first-serve basis. Payments must be made by credit card or cash. No checks will be accepted at the Festival site. All sales are final. No refunds, exchanges or replacements will be made for any reason. Tickets for America’s Test Kitchen Boston EATS are not tax deductible.
RIGHT TO USE YOUR NAME, VOICE, IMAGE AND LIKENESS
By using your ticket and attending the Festival, Attendee grants Festival Organizer and its affiliates and licensees the world-wide, royalty-free, irrevocable, transferable, perpetual right and license to publish, print, display, record and use (by photograph, film, tape, digital or aural devices and any other method or device) the Holder’s name, voice, image and likeness while at the Festival (the “Recordings”), and use such Recordings for any and all purposes, in any and all media now known or hereafter devised.
Attendee agrees not to record, transmit, distribute, or sell or aid in the recording, transmission, distribution, or sale of any description, account, picture, video, audio or other form or reproduction of the Festival or any surrounding activities (in whole or in part). No ticket or other Festival item may be used for any form of commercial or trade purposes, including, but not limited to, advertising, promotions, contests or sweepstakes, without the express written consent of America’s Test Kitchen.
RESPONSIBLE CONSUMPTION OF PRODUCTS
As a responsible member of the community, Festival Organizer recognizes the concern about drinking and driving, and promotes and supports only the responsible consumption of alcoholic beverages and other products at the Festival. Attendee is solely responsible for Attendee’s personal well-being and agrees to responsibly consume products offered at the Festival. Valid photographic identification will be required for the consumption of any alcoholic products at the Festival. Festival Organizer or any other Festival participant may, in their absolute discretion, refuse to sell or serve alcohol to you or remove you from the Festival if they determine it appropriate to do so. If Attendee believes that he or she is impaired or that Attendee cannot safely operate a motor vehicle, please seek immediate assistance.
Only small clutches, purses and easily searchable bags will be admitted. Festival Organizers reserve the right to search all bags and persons at the Festival at any time for prohibited items. Prohibited items include, but are not limited to: outside food and beverages, drugs, weapons, dangerous or controlled substances, backpacks, large bags, and suitcases. No alcoholic beverages of any kind, opened or unopened, may be brought on to or removed from the festival or the event site for any reason.
ASSUMPTION OF RISK; RELEASE
Attendee voluntarily assumes all risks and dangers incidental to the Festival, whether occurring prior to, during, or after the Festival, including, without limitation, personal injury and death and any other loss, damage or liability. Attendee expressly and voluntarily agrees that Festival Organizer, and its respective officers, directors, owners, affiliates, employees and agents acting by and through them, are expressly released by Attendee from any claim incidental to the Festival. Festival Organizer is not responsible for any lost or stolen articles.
